Privacy Policy

This policy explains what personal information High Performance Founder collects from coaching clients, why, and your rights over it. High Performance Founder is a coaching brand operated by Body Transformation Mastermind, Inc. (a federal Canadian corporation, 106-460 Doyle Ave, Kelowna, BC, Canada, V1Y 0C2), which is the data controller ("we", "us").

1. What we collect

• Contact & account: name, email, phone, country.
• Payment: handled by our payment processor (Stripe / CourseCreator360); we do not store full card numbers.
• Health data (special category): body weight over time, height, body-fat %, date of birth, biological sex, injuries and medical conditions, dietary restrictions and preferences, training and activity information.
• Postal address (optional): street address, city, region, postal code, country, and any delivery notes you choose to add. We only hold this if you choose to give it to us.

2. Why we process it, and our legal basis

• To deliver the coaching you purchased — legal basis: performance of our contract with you.
• For your health data specifically — legal basis: your explicit consent (given separately at your consultation). You can withdraw it at any time (see §6); because this data is essential to the coaching, withdrawal means the coaching cannot continue.
• To help your coach prepare your check-ins and coaching notes, we use an AI tool (Anthropic's Claude) to draft them. A human coach reviews every draft before it is sent, so no decision about you is made by AI alone. Where this uses your health data, the legal basis is your explicit consent (above).
• To send you welcome materials and items your coach orders on your behalf, and to help identify body-composition scan facilities near you — legal basis: your consent. Giving us your postal address is optional; you can decline it, and change or withdraw it at any time (see §6). If you decline, we cannot send you physical items.

3. Who we share it with (our processors)

We use trusted providers who process data on our behalf under data-processing agreements:

• Trainerize — coaching-delivery platform (workouts, check-ins, progress, body metrics).
• Supabase (hosting) / AWS — our secure database.
• Stripe / CourseCreator360 — payments.
• GoHighLevel — CRM.
• Fathom — call summaries (where applicable).
• Anthropic — the AI assistant (Claude) that drafts coaching messages and notes for your coach to review. Anthropic does not use your data to train its models and deletes its processing logs within 30 days.
• Amazon and delivery carriers — where you have given us a postal address, we share it with Amazon and shipping carriers solely to deliver items to you.

We do not sell your data or use it for advertising.

SMS opt-in consent and phone numbers collected for SMS purposes will not be shared with any third parties or affiliates for marketing purposes. The only exception is the messaging provider that delivers the messages on our behalf, which may not use your number for its own purposes.

4. International transfer

Our database is hosted in the United States, and our AI drafting provider (Anthropic) also processes data in the United States. Where we transfer data out of the EEA/UK/Switzerland, we rely on the EU Standard Contractual Clauses (and the UK addendum) in our providers' data-processing agreements as the safeguard.

5. Retention

We keep your data for the duration of your coaching and for a reasonable period after, to meet legal, tax and dispute-resolution obligations, then delete or anonymise it. Backups are encrypted and retained on a rolling 30-day cycle.

Where you have given us a postal address, we keep it while your coaching is active, and delete it 24 months after we last used or updated it — sooner if you ask us to remove it.

6. Your rights

You can request access to, correction of, or deletion of your data; withdraw your health-data consent; object to or restrict processing; and receive a portable copy. You also have the right to complain to your data-protection authority (in the EU, your national authority; in Canada, the Office of the Privacy Commissioner).

7. Security

Data is encrypted in transit and at rest, access is restricted and role-limited, and our database enforces row-level security.

9. Cookies and tracking

Our website and landing pages use cookies and similar tracking technologies. These are used to keep the site working, to remember your cookie preferences, to measure how pages perform, and to measure the effectiveness of our advertising — including the Meta (Facebook) pixel and our own analytics.

You can control or clear cookies in your browser at any time, and where a cookie banner is shown you can decline non-essential cookies there. Declining does not affect your ability to apply or to be coached.

10. SMS and text messages

If you give us your phone number, you may separately and optionally agree to receive text messages from High Performance Founder. Agreeing is never a condition of applying, of buying anything, or of receiving any service from us, and the consent box is not pre-selected.

We use text messages only for service and support — for example:

• confirming that we received your application;
• arranging a time to speak;
• confirming the coaching session you booked, reminding you of it, or telling you about a change to it.

We do not send marketing or promotional text messages.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or reply HELP for help. You can also email dan [at] highperformancefounder [dot] com to be removed. Our texts are sent from +1 904-842-3634.

We keep a record of when you agreed and which wording you were shown, so that we can show what you consented to.

We'll post updates here with a new "last updated" date; material changes affecting your health-data consent will be notified to you.
